Terms and Conditions of Trade
Cycled Design Raglan

1. Introduction
Welcome to Cycled Design Raglan (“we”, “our”, “us”). We are a locally owned studio based in Raglan, New
Zealand, focused on sustainable and circular design practices.
By purchasing our products or using our services, you agree to be bound by these Terms and Conditions
(“Terms”). These Terms govern all use of our website, products, and services, including but not limited to laser
cutting, engraving, CAD design, print-copy services, 3D printing, and custom fabrication.
2. Legal Jurisdiction
These Terms are governed by the laws of New Zealand. All transactions are deemed to occur within New
Zealand, and any disputes will be resolved in accordance with New Zealand law.
3. Consumer Guarantees Act 1993 (CGA)
Where you are a consumer, nothing in these Terms limits your rights under the Consumer Guarantees Act 1993.
Where goods or services are supplied for business purposes, the parties agree that the provisions of the CGA are
excluded to the maximum extent permitted under section 43 of the Act.
4. Fair Trading Act 1986 (FTA)
Cycled Design complies with the Fair Trading Act 1986.
Clients acknowledge that they have not relied on any representation, statement, or warranty not expressly
confirmed in writing by Cycled Design.
5. Products and Services
Cycled Design provides:
Custom laser cutting and engraving (including use of Mira 9 Laser)
CAD design services (2D and 3D modelling)
3D printing services
Print and copy production (A4/A3)
Bespoke design, fabrication, and sustainable packaging
Locally made, small-batch products using reclaimed or customer-supplied materials
All descriptions and pricing are indicative only and subject to change without notice. Final pricing is confirmed
via written quotation.
6. Lead Times and Availability
Typical lead times are 5–10 working days unless otherwise agreed.
Delays due to material availability, client revisions, machine downtime, or external factors may extend lead
times. Cycled Design is not liable for delays beyond its reasonable control.
7. Waiver and Limitation of Liability
By using our services or purchasing our products, you acknowledge and agree to the following:
Material Use
Where reclaimed, upcycled, or customer-supplied materials are used, Cycled Design is not liable for
inconsistencies, defects, or performance issues arising from the inherent nature of those materials.
Design Input
Clients providing their own files or designs accept full responsibility for:
File accuracy
Copyright ownership
Suitability for production
Cycled Design is not responsible for errors, production delays, or outcomes resulting from inaccurate or
incomplete files.
Laser, 3D Printing and Fabrication Processes
Clients acknowledge that manufacturing processes may result in:
Minor warping
Burn marks or surface variation
Layer lines (3D printing)
Dimensional tolerances and variation
Material-specific inconsistencies
These are considered normal and acceptable outcomes.
Custom Orders
All custom designs, fabricated items, and made-to-order products are final and non-refundable.
Clients are responsible for reviewing and approving all proofs prior to production.
Injury or Damage
Clients are responsible for safe handling, installation, and use of all products.
To the maximum extent permitted by law, Cycled Design shall not be liable for:
Personal injury
Property damage
Indirect or consequential loss
arising from misuse, modification, or improper installation.
Construction Use
Harold Gavin Drinn trading as Cycled Design will not be held liable for any construction faults, failures, or
damages arising from the use of any design, product, or material supplied.
Any resolution offered will be at the sole discretion of Cycled Design and limited to what is reasonable.
Architectural Concept and Design Liability
All architectural drawings, concept designs, visualisations, CAD models, and related outputs are provided for
conceptual and illustrative purposes only, unless explicitly agreed otherwise in writing.
Cycled Design does not provide:
Architectural certification
Engineering approval
Construction documentation suitable for building consent
unless separately contracted.
Where any design is used for construction, fabrication, or real-world implementation:
All risk and responsibility is assumed entirely by the client or third party
Cycled Design shall have no liability whatsoever for:
o Structural integrity
o Compliance with the New Zealand Building Code
o Build quality or outcomes
o Financial loss, damage, or injury
Clients must engage qualified professionals (e.g. Licensed Building Practitioners, engineers, architects) before
construction.
8. Limitation of Liability
To the maximum extent permitted by New Zealand law:
Total liability is limited to the amount paid for the relevant product or service
Cycled Design is not liable for any indirect, consequential, or economic loss
9. Indemnity
You agree to indemnify and hold harmless Cycled Design against any claims, damages, losses, or liabilities
arising from:
Misuse of products or services
Use of designs outside intended purpose
Breach of these Terms
10. Intellectual Property
All original CAD drawings, laser files, and product designs remain the intellectual property of Cycled Design
unless otherwise agreed in writing.
Unauthorised reproduction, distribution, or resale is strictly prohibited.
11. Environmental Commitment
Cycled Design is committed to waste reduction and circular design.
We prioritise reclaimed materials and aim to reduce construction and demolition waste in Aotearoa by
repurposing materials into functional, long-lasting products.
12. Payment Terms
All prices are in NZD and subject to GST unless stated otherwise.
Payment is due upon order confirmation unless otherwise agreed. Late payments may incur additional fees or
interest.
13. Cancellations, Refunds, and Returns
Cancellations must be made in writing before production begins
Custom and made-to-order items are non-refundable unless faulty
Personalised or bespoke items cannot be returned
Claims for incorrect or damaged items must be made within 7 days of receipt
14. Online Sales & Third-Party Links
Our website may include links to third-party services. Cycled Design is not responsible for their content,
accuracy, or privacy practices.
15. Updates to Terms
We reserve the right to amend these Terms at any time without notice. Updated Terms take effect immediately
upon publication.
